The following Email Hero Awards Contest Official Rules (“Official Rules”) apply to your (“you” of “Entrant”) participation in the Email Hero Awards Contest (the “Contest”) sponsored by Validity, Inc. (“Validity” or “Sponsor”). NO PURCHASE OR PAYMENT NECESSARY TO ENTER. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED. The Contest begins on November 19, 2019 at 6:00 am and ends on January 31, 2020 at 11:59:59 pm (“Entry Period”). Winners will be announced by March 2, 2020 at 11:59:59pm. All times in these Official Rules are Pacific Time.

1. Process.

To enter the Contest, visit https://www.validity.com/email-heros/ (Contest Website”) and submit a completed submission form (“Form”) during the Entry Period. Entrants can only submit a Form on their behalf and must complete all fields of the Form, which will include contact information, industry, goals of the campaign, key challenges, results attained, screenshots (.gif, .jpeg, .jpg, .tiff, .png) of the campaign a. Entries will be judged based on the Judging Criteria set forth in Section 6 below. Entrants may submit multiple entries for each Category (as defined below). Entrants must submit a complete and separate Form for each entry. You must provide a legal and corporate communications contact from your company for each entry. BY ENTERING THE CONTEST, YOU HEREBY AGREE TO THESE OFFICIAL RULES. Entries will be disqualified if they are late, incomplete and/or in excess of the stated entry limits. In addition to completing the Form, each eligible Entrant may also submit additional supporting materials and data in the form of a screenshot of the campaign and supporting data (including inbox placement rate, read rate, open rate, etc.) to support their submission. The supporting materials should be used to support the key elements of the Judging Criteria. All materials must be in English and original. Sponsor may display all entries on any Validity website, social media channel, Validity events as well in accordance to with the Grant of Rights set forth in Section 7. All Entries submitted are the property of Validity.

2. Eligibility.

The Contest is open to companies who (i) are a current customer of Validity or its affiliates, in good standing as of the last day of the Entry Period, (ii) are registered and domiciled in the Contest Area (as defined below), (iii) have approval to enter the Contest from an individual at your company who has the authority to bind the company to these Official Rules. By entering the Contest on behalf of your company you warrant that you are at least twenty-one (21) years of age and authorized to enter on its behalf and agree to these Official Rules. Failure to meet the eligibility requirements may result in an entry being invalid and/or forfeiture of any prize. Entrants outside of the Contest Area are not eligible to enter or win. Employees or officials of any government entity are not eligible to participate or win. The Contest is void where prohibited or restricted by law and is subject to all applicable federal, state and local laws and regulations. Employees (and their immediate families and household members) of Validity and its affiliates and agents are not eligible to participate. Validity is not responsible for registration errors or for lost, late or misdirected entries, or telecommunication or computer hardware or software failures in connection with your participation. Validity reserves the right in its sole discretion to (1) terminate or modify the Contest, (2) disqualify any individual who tampers with the entry process or the administration of the Contest, and/or (3) substitute a different prize (provided that any such substitution shall be of equal value to the Grand Prize). “Contest Area” means: United States of America and the United Kingdom. Validity makes no warranty, representation, or guarantee, express or implied, in fact or in law, relative to the Contest, or the Prize including, without limitation, quality, merchantability, or fitness for a particular purpose.

3. Prize.

There will be:

(a) one (1) overall winner (“MVP”). The MVP will receive:
      (i) Trophy/Plaque
      (ii) Certificate
      (iii) Induction into Client Spotlight Program + Early Access
      (iv) One-time feature in eBook and blog post
      (v) Opportunity to be featured in future case study on website and in conferences
(b) one (1) winners for each Category (“Category Winner(s)”) for a total of nine (9) Category Winners. Each Category Winner will receive:
      (i) Trophy/Plaque
      (ii) Certificate
      (iii) Induction into Client Spotlight Program + Early Access
      (iv) One-time feature in eBook and blog post
      (v) Opportunity to be featured in future case study on website
(c) one honorable mention finalist for each Category (“Finalist”) for a total of nine (9) Finalists. Each Finalist will receive:
      (i) Certificate
      (ii) Induction into Client Spotlight Program + Early Access
      (iii) One-time feature in eBook and blog post
      (iv) Opportunity to be featured in future case study on website

4. Submission Categories.

Entrants may submit an entry for more than one category (“Category” or “Categories”). will select one (1) Category Winner per each Category and one (1) Finalist per each Category. The Categories are as follows:

  • Best Subject Line
  • Best Newsletter
  • Best Offer (coupons, promotion)
  • Best Triggered
  • Most Improved/Deliverability Bounceback
  • Most Creative/Innovative
  • Best Email Series
  • Best Themed Email (E.g., Holiday)
  • Best Winback Email
  • MVP Email Hero

5. Judging.

Using the criteria for each Category set forth below (“Judging Criteria”), a group of five (5) email industry professionals will judge all eligible entries received during the Entry Period and select one Category Winner and one Finalist for each Category, and one overall MVP Email Hero. Each Judging Criterion is weighted equally.

    How did this subject line increase read rate and open rate? How did this subject line’s performance (read rate) compare (to other sends, other brands, etc)? What creative elements were included in the subject line?
  • Best Newsletter
    How well does this newsletter offer digestible content with a user-friendly layout? How well does this newsletter foster relationships/provide value? What are the open rates, read rates, click rates of this newsletter?How does the newsletter render across environments?
  • Best Offer (coupons, promotion)
    How well did this offer do in capturing conversions (if data available)? What are the open/click-through rates for this email? How creative is the offer? What is new and different? How is the offer presented in the email?
  • Best Triggered
    How well did this email perform in regards to open / read rate? How did this triggered message drive subscriber engagement? What is the email performance of this campaign (opens, clicks, read rate)?
  • Most improved/Deliverability Bounceback
    How did your email program improve over time in regards to inbox placement and deliverability?
  • Most creative/innovative
    How does this campaign compare to others we’ve seen in the industry? Does this campaign stand out from the crowd?
  • Best Email Series
    How does this series benefit the subscriber? How does this series keep subscribers engaged?
    What is the email performance of this series?
  • Best Themed Email (Holiday, etc.)
    How does this stand out from other emails in the inbox? How creative is the theme choice and design?
    What is the email performance of this send (open rate, click-rate, read rate)?
  • Best Winback Email
    How did this email drive opens, reads, and clicks? How did it compel unengaged subscriber to take a new action?
  • How effective was this campaign in reactivating lapsed subscribers after this email was sent? Is this win-back email part of a series? If so, how did the overall win-back series perform?
  • MVP Email Hero
    Overall top performer across all categories. What category winner drove the highest lift in deliverability/opens/reads/clicks/conversions? What category winner had the best stand-out, creative approach?

If a judge or participant notifies us of a conflict of interest, we will investigate and based on our findings we may or may not recuse the judge. Entries may be subject to a due diligence review at any time for eligibility and compliance with these Official Rules. Determination of eligibility and compliance is at our sole discretion, and may result in the disqualification of your entry. Sponsor will attempt to notify both Category Winners and Finalists on or about March 1, 2020. Winners will be notified by email, phone and/ or regular mail and may be required to sign and return a declaration of eligibility and compliance with these Official Rules, a publicity/liability release (unless prohibited by law), and any other requested documents within the time period stipulated in the documents. Failure to comply with this requirement may result in disqualification. Any notification returned as undeliverable may result in disqualification.

6. Odds.

Odds of winning will depend on the number of valid entries received during the Entry Period and the relative performance of each entrant.

7. Conditions; Grant of Rights.

By participating, you expressly acknowledge compliance with these Official Rules, including all eligibility requirements. By participating in this Contest, each entrant hereby expressly grants and consents to Sponsor (and Sponsor’s licensees and assigns) a royalty-free, irrevocable, perpetual, transferable, non-exclusive license to use, reproduce, modify, edit, publish, create derivative works from, distribute, and display, as applicable, in whole or in part, and otherwise exploit the submission in all media now known or hereafter devised, throughout the universe, in any way Sponsor sees fit including, but not limited to, at any and all event venues and sessions, and for entertainment, instructional/educational, promotional, advertising, marketing materials (e.g., case studies) and/or marketing purposes each of the following: (1) any information or content, including the Form, submitted in relation to this Contest, (2) your corporate name, designation, logo, trademarks, (3) any recorded feedback, testimonial, or speech related to the Contest, which each entrant also hereby consents to Sponsor having the right to record, and/or (4) your name, video, photograph, voice, or likeness, which you hereby consents to, without additional compensation, unless otherwise prohibited by law, as it relates to the Contest. In connection with all rights granted in these Official Rules, you also grant to Sponsor (and Sponsor’s licensees and assigns) the irrevocable right to incorporate Contest submissions, in whole or in part, into other works, in any form, media, or technology now known or hereafter developed. You also agree that you will sign any necessary documentation that may be required for Sponsor or its designees to make use of the non-exclusive rights in the Contest submission you are granting to Sponsor. If you include in your Contest submission any names, voices, likenesses, or personal information (“Attributes”) of any third person, you are representing that you have authority and permission from such third person to, and do hereby, grant to Sponsor all of the rights set forth in this paragraph in such third person’s Attributes, and, in the event that such person is under the age of majority in your country or state of residence, that you are that person’s parent, legal guardian, or statutory agent with authority to grant to Sponsor all of such rights in the minor’s Attributes. You also agree that any creative ideas, suggestions, or other materials submitted by you in connection with this Contest, in any form, are not being made in confidence or trust and that no confidential or fiduciary relationship is intended or created between you and us in any way, and that you have no expectation of review, compensation or consideration of any type. Nothing in these Official Rules will be deemed to give you any right to use or publish the Sponsor marks, logos, or any other trademark of Validity or any other content provided by Sponsor, whether contained in the Contest submission or otherwise, without Sponsor’s prior written consent. You agree and acknowledge that Validity owns all right, including intellectual property rights, title, and interest in and to the aforementioned materials, including marketing materials, blog articles, and case studies, and that no title or ownership of any related intellectual property rights is or shall be transferred by Validity to you.

8. Limitation of Liability.

Sponsor and its parent, subsidiaries, affiliates and promotional agencies, and their respective officers, directors, employees, representatives and agents, are not responsible for lost, incomplete or incorrect entries, and shall have no liability for any damage, loss or liability to any person or property due in whole or in part, directly or indirectly, to the acceptance, possession, use or misuse of a prize or to participation in this Contest. As a condition of entering this Contest, participant agrees that under no circumstances will participant be entitled to any awards for any losses or damages, and participant hereby waives all rights to claim punitive, incidental, consequential and any other damages, and waives any and all rights to have damages multiplied or otherwise increased. In the event that the operation, security, or administration of the Contest is impaired in any way, as determined in Validity’s sole discretion, Validity shall have the right, without limitation, to: (a) suspend the Contest to address the impairment and then resume the Contest; (b) award the prize according to the criteria set forth above from among the eligible entries received up to the time of the impairment, (c) extend any deadlines; (d) cancel the Contest; or (e) take any other reasonable action as we deem necessary and appropriate to the circumstances.

9. Release.

BY ENTERING THE CONTEST, EACH ENTRANT RELEASES AND AGREES TO HOLD HARMLESS SPONSOR AND ITS PARENT, SUBSIDIARIES, AFFILIATES AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS FROM ANY LIABILITY WHATSOEVER FOR ANY CLAIMS, COSTS, LOSSES, OR DAMAGES OF ANY KIND (INCLUDING, WITHOUT LIMITATION, THOSE RELATED TO PERSONAL INJURY, DEATH, DAMAGE TO PROPERTY, INFRINGEMENT OF PROPRIETARY RIGHTS, RIGHTS OF PUBLICITY OR PRIVACY OR DEFAMATION) ARISING OUT OF OR IN CONNECTION WITH: (I) ENTERING THE CONTEST; (II) USE OF ANY FORMS OR CONTENT SUBMITTED IN CONNECTION WITH THE CONTEST IN ACCORDANCE WITH THESE OFFICIAL RULES (II) ACCEPTANCE OR USE OF ANY PRIZE; AND (III) OTHERWISE ARISING OUT OF OR RELATING TO THE CONTEST.

10. Force Majeure.

If someone cheats, or a virus, bug, catastrophic event, or any other unforeseen or unexpected event that cannot be reasonably anticipated or controlled, affects the fairness and/or integrity of this Contest, Validity reserves the right to cancel, change, or suspend this Contest. This right is reserved whether the event is due to human or technical error. Hacking is a crime. If you attempt to compromise the integrity or the legitimate operation of this Contest by hacking or by cheating or committing fraud in any way, Validity may seek damages from you to the fullest extent permitted by law and you may be prohibited from participating in any future Contest.

11. Conduct.

BY ENTERING AND PARTICIPATING IN THIS CONTEST, ENTRANTS: (A) FULLY AND UNCONDITIONALLY AGREE TO BE BOUND BY THESE OFFICIAL RULES AND BY ALL DECISIONS OF SPONSOR (WHICH DECISIONS SHALL BE FINAL AND BINDING IN ALL RESPECTS), INCLUDING WITHOUT LIMITATION DECISIONS REGARDING ELIGIBILITY, WINNERS AND THE INTERPRETATION OF TERMS USED IN THESE OFFICIAL RULES; (B) REPRESENT AND WARRANT THAT ALL INFORMATION PROVIDED BY ENTRANT IN CONNECTION WITH THE CONTEST IS TRUE, ACCURATE AND COMPLETE; AND (C) AGREE TO COMPLY WITH ALL LAWS. SPONSOR RESERVES THE RIGHT, AT ANY TIME AND AT ITS SOLE DISCRETION, TO DISQUALIFY AND/OR DEEM INELIGIBLE TO PARTICIPATE IN THIS CONTEST OR ANY FUTURE SPONSOR PROMOTIONS, ANY INDIVIDUAL IT SUSPECTS: (A) TO BE TAMPERING WITH THE ENTRY PROCESS OR THE OPERATION OF THE CONTEST OR ANY WEBSITE; (B) TO BE ACTING IN VIOLATION OF THE OFFICIAL RULES OR SPONSOR’S PRIVACY POLICY OR OTHER TERMS, CONDITIONS OR GUIDELINES; (C) TO BE ACTING IN BAD FAITH OR IN A DISRUPTIVE MANNER, OR WITH THE INTENT TO ANNOY, ABUSE, THREATEN OR HARASS ANY OTHER PERSON; (D) TO HAVE FAILED TO AGREE TO THESE OFFICIAL RULES; OR (E) TO BE IN VIOLATION OF THESE OFFICIAL RULES. ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY INTERNET SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF THESE OFFICIAL RULES AS WELL AS CRIMINAL AND CIVIL LAWS. SHOULD SPONSOR BELIEVE OR BECOME AWARE THAT SUCH AN ATTEMPT HAS BEEN, IS BEING, OR WILL BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES FROM ANY RESPONSIBLE ENTRANT(S) AND OTHER RESPONSIBLE INDIVIDUAL(S) IN THE ATTEMPTED DAMAGE TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING WITHOUT LIMITATION CRIMINAL PROSECUTION.

12. Taxes.

Unless otherwise agreed in writing by Validity, the Winner is solely responsible for any costs, expenses, taxes and custom fees due in connection with the prize, its delivery and use.

13. Information Submitted.

You agree that you will fill out the Form truthfully and completely. You hereby grant Validity and its affiliates with an irrevocable, worldwide, perpetual license to use your Form responses in connection with improving, marketing, and/or selling Validity’s (or such affiliates’) solutions. Except as otherwise set forth herein, use of the information submitted in the Form and Contest is governed by Validity’s privacy policy, which can be found at https://www.validity.com/privacy-policy/.

14. Governing Law.

These Official Rules are governed by, construed and enforced in accordance with the laws of the Commonwealth of Massachusetts. Any action by you or any third party brought to enforce these rules or, in connection with any related matters shall be brought only in Boston, Massachusetts, and you expressly consent to the jurisdiction of said courts.
